CAR ACCIDENT SETTLEMENTS

Pennsylvania Car Accident Lawyer

Since 1981, Attorney Newell has served the legal needs of car accident victims.

Listed below are summaries of car accident cases that Attorney Newell has successfully resolved.  Of course, each car accident claim must be evaluated based upon a variety of factors - including the age of the personal injury victim, their specific injuries, violations of the Pennsylvania Vehicle Code and available insurance coverages.

The financial compensation that Attorney Newell obtained for one car crash victim does not guarantee the same recovery in another personal injury case.

Pike County, PA

$370,000.00

Bushkill, PA resident was severely injured in a car accident in New Jersey.  Various types of conservative treatments were used to treat her low back injury - including physical therapy, medications and epidural injections.

Unfortunately, the car accident victim's low back pain grew progressively worse and her treating doctors informed her that surgery was her only option.  A surgeon performed lumbar fusion surgery to remove the damaged disc in her low back.  The PA personal injury victim was left with a permanent scar and a loss of range of motion at the surgery site.

Attorney Newell obtained the maximum liability coverage amount from both the Defendant driver's auto policy, as well as the Pike County resident's underinsured motorist coverage limit.  Her car accident attorney also garnered for her the maximum insurance payments for her medical bills and lost wages.  The total financial recovery for the car crash victim was $370,000.00.

Northampton County, PA

$280,000.00

A couple from the Lehigh Valley were involved in a car crash on Rt. 329 near Bath, PA.  The car accident happened when a car ran a red light, made a left turn and crashed into their motor vehicle.  The auto accident totaled their van and, the force of the collision thrust the wife into the dashboard and windshield.

The personal injury victim was taken by ambulance to St. Luke's Hospital in Bethlehem, PA.  She suffered from numerous left hip fractures, including a large oblique fracture of the femoral head.  She also sustained a dislocated hip.

Once CT scans and x-rays identified the severity of the car accident victim's injuries, she was taken to the operating room where an orthopaedic surgeon from Bethlehem performed a closed reduction of her left hip.  A short time later, a second surgery was performed to install a screw to hold a large bone fragment in place.

Unfortunately, due to the multiple fracture sites, the Lehigh Valley treating physicians could not stabilize her hip.  The PA car crash victim was forced to undergo a third surgery - this time it was a total hip replacement.

While the Northampton County resident was recovering, Attorney Newell was demanding that the insurance company representing the Defendant pay its policy limit.  They refused to do so and Attorney Newell filed suit versus the negligent driver.  The actions by her car accident lawyer caused a prompt payment of the $280,000.00 - the maximum coverage limit of $250,000.00 from the Defendant and $30,000.00 from her underinsured motorist coverage.

Tioga County, PA

$230,000.00

Three Pennsylvania residents were involved in a car crash in New York.  The car accident occurred when a speeding motorist could not stay in her lane and crashed into their automobile head-on.  One personal injury victim sustained 3 fractures to her ankle, a fracture of her tibia, a fracture of her fibula and 6 broken ribs.  The PA native underwent multiple operations, including an open reduction of her left leg with internal fixation via a rod with locking bolts.

Another motor vehicle accident victim suffered a comminuted fracture to her left lateral orbital rim, a comminuted fracture to her left lateral orbital area, as well as fractures to her left zygomatic arch.

The driver of the automobile had multiple fractures to his fibula which required open reduction surgery with a plate attached to his fibula via seven screws.  This motor vehicle collision victim also underwent an open reduction and internal fixation surgery for his right tibia fracture.

Attorney Newell quickly obtained the surgical records and procured payment of the Defendant's $100,000.00 liability policy limit.  He then made underinsured motorist claims against the insurance companies that provided insurance coverage for the auto the personal injury victims were in and also against their own automobile insurance carriers.  Each underinsured motorist claim was settled for the policy limit which resulted in UIM settlements totaling $130,000.00.

The underinsured motorist lawyer wanted to obtain a total settlement exceeding the $230,000.00 payout.  However, one of the car crash victims had signed a waiver of stacking form which, unfortunately, met the requirements of the Pennsylvania Motor Vehicle Financial Responsibility Law.  This signed waiver prevented Attorney Newell from obtaining additional underinsured motorist claim benefits.

A car accident occurred near Rt. 209 in Bushkill, PA.  A Bushkill resident was driving her car when an oncoming vehicle turned left in front of her.  The car crash victim veered to the right hoping to avoid the collision.  Unfortunately, she crashed into the other car when both motor vehicles were completely off the road.

A MRI was taken of her neck which showed 2 herniated disks.  The auto accident victim was initially sent for physical therapy with a specialist from the Pocono Mountains.  Due to increasing symptoms of numbness, tingling and radiating pain, it was necessary for the Bushkill resident to undergo an anterior cervical fusion with a left iliac crest autograft harvest.

After her medical care had concluded, Attorney Newell attempted to negotiate a settlement with the other driver's auto insurance company.  They refused to offer any amount - claiming that the motor vehicle accident occurred because the Pocono Mts. resident was driving too fast and lost control of her automobile.
