DOG BITE SETTLEMENTS

Pennsylvania Dog Bite Lawyer

Attorney Newell has represented many dog bite victims since he began handling personal injury claims in 1981

Listed below are summaries of dog bite settlements that Attorney Newell has successfully resolved. Of course, each dog bite case must be evaluated upon a variety of factors - including the age of the personal injury victim, their injuries, violations of the PA Dog Law and/or prior vicious propensities.

The financial compensation that Attorney Newell obtained for one dog bite victim, does not guarantee the same settlement in another personal injury case.

Montgomery County, PA

A young boy from Montgomery County was the victim of a dog bite attack while playing in his backyard.  A neighbor's German Shepherd was running loose in the development and, without warning, attacked him. The dog bite victim sustained severe lacerations around his mouth which totaled 12 centimeters.

The Montgomery County resident was rushed by ambulance to a nearby hospital. A significant portion of his lip was missing and he was prepped for surgery. After the personal injury victim was placed under anesthesia, debridement and a reconstruction of the left lateral commissure was performed.

Over the next 1.5 years, the dog bite victim was required to wear three different types of facial splints, as well as endure multiple therapy sessions. Because of the severity of the dog bite wounds, a second surgery was performed. The operating surgeon identified the procedure as a left oral commissurotomy with dermabrasion.

Attorney Newell was hited to serve as the dog bite attorney for this severely traumatized young boy. An investigation revealed that the German Shepherd had previously attacked numerous people in the past. All of these dog bite attacks were unprovoked.

Attorney Newell pursuasively argued that this German Shepherd was truly a "dangerous dog" and, that its owners were guilty of gross negligence in permitting the dog to run free in the neighborhood.

The homeowner's insurance company representing the owners of the German Shepherd agreed to a structured settlement with payments over time to the personal injury victim totaling more than $479,000.00. Judge Ott of the Orphans Court of Montgomery County approved the Petition for Minor's Compromise presented by Attorney Newell.

Northampton County, PA

An unprovoked dog bite attack occurred in the Lehigh Valley the day after Christmas.  A young girl was visiting her friend when the girlfriend's Chow jumped up and bit her face. The Chow continued the attack by chasing the Walnutport, PA resident down the hall and biting her leg and hand as she tried to enter a bedroom to escape from this dangerous dog.

As a result of the dog bite attack, the Northampton County resident suffered significant lacerations to her face. She was taken to Palmerton Hospital where the emergency room doctor used nearly 20 stitches to close the dog bite wounds.

At the request of Attorney Newell, the personal injury victim was examined by a plastic surgeon eight months after the dog bite attack. The doctor felt that the scars were healing well without any significant elevation or depression. Therefore, the medical expert indicated that scar revision surgery would not be necessary.

While the dog bite victim was recuperating, Attorney Newell was investigating a potential negligence claim against the Chow's owners. Since the dog bite attack occurred inside the Defendants' home, there was no apparent violation of the Pennsylvania Dog Law.

In order for the girl to obtain a financial recover, her dog bite lawyer needed to prove prior vicious propensities regarding this Chow. Attorney Newell undertook his investigation by interviewing the property manager of the Northampton County Community where the dog's owners lived.

Attorney Newell was informed that the Chow had attacked, without provocation, a family member just months earlier. The property manager had instructed the owners of the dog to get rid of it. However, they refused her request and continued to harbor this dangerous dog in their home.

The homeowner's insurance company for the owners of the Chow agreed to settle the dog bite victim's personal injury claim for $36,000.00. Attorney Newell presented a Minor's Compromise Petition to Judge Edward G. Smith of the Northampton County Court of Common Pleas. Judge Smith approved the settlement and congratulated Attorney Newell on the outstanding financial recovery for this dog bite claim.

The Carbon County dog bite victim was taken to Gnaden Heutten Memorial Hospital in Lehighton, PA. The laceration to her hand required 7 stitches to close. According to the Center for Disease Control, the majority of dog bite attack victims are children. Such as the case when a young boy from the Lehigh Valley was visiting at a relative's home.
