I was traveling on Rt. 313 near Quakertown, PA when an uninsured SUV crossed over the double yellow line and hit me head-on.  If I make an uninsured motorist claim against my car insurance company, will my insurance rates go up?

Monroe County, PA 

 $176,000.00 

A Tobyhanna, PA resident made an uninsured motorist claim after sustaining severe injuries to his leg in a car accident.  The Pocono Mts. injury victim was diagnosed with a tibia fracture, as well as 2 fibula fractures.  Complex surgery to the car crash victim's leg included the installation of a plate inside his leg and an external fixation device attached to the outside of his right leg.

Four months later, the Pocono Mts. resident had surgery to remove the external fixator.  As a result of the significant trauma, the personal injury victim developed severe degenerative changes to his injured leg.

Since the negligent driver was uninsured, Attorney Newell made an uninsured motorist claim to the car accident victim's insurance carrier.  After unsuccessful settlement discussions, Attorney Newell presented the uninsured motorist claim at an Arbitration Hearing in Easton, Pennsylvania.  The car accident victim received an Arbitration Award of $176,000.00.

Monroe County, PA 

 $139,000.00 

An uninsured motorist claim was made on behalf of a Stroudsburg, PA resident. She was driving her car on Rt. 191 in the Pocono Mts. when an automobile came over the center lane and forced her off the road. The car accident victim's automobile crashed into an embankment.

The hit and run driver fled the scene of the car crash. She was knocked unconscious in the crash. After regaining consciousness, she complained of feeling dizzy and lightheaded and, was taken to a nearby hospital.

The car crash victim saw her Pocono Mts. family doctor and a neurologist from the Stroudsburg, PA area. MRI's were taken of her brain, cervical spine and lumbar spine. Both the neck and low back had sustained a herniated disk. An SEP of her legs showed an abnormality.

The Stroudsburg resident was placed on Skelaxin and Darvocet. She also started physical therapy sessions. When this conservative treatment didn't help, an East Stroudsburg doctor gave her nerve block injections, as well as epidural steroid injections.

The personal injury victim's car insurance company refused to make an uninsured motorist settlement offer. Attorney Newell demanded an uninsured motorist arbitration. The Sworn Statements of the Stroudsburg resident and her husband were taken.

Shortly after that, Attorney Newell was able to negotiate a total uninsured motorist settlement of over $139,000.00 to compensate the Pocono Mts. resident for her pain and suffering, along with her lost wages.

Monroe County & Northampton County, PA 

 $75,000.00 

A Pocono Mts. resident was a passenger in a company van driving on Easton Ave. in Northampton County when an uninsured motorist ran a stop sign causing the car accident.  The uninsured motorist claim victim initially tried to self-treat the problems he was experiencing with his neck and right shoulder.

The car crash victim then came under the care of a chiropractor from Mt. Pocono, PA.  Physical therapy and chiropractic manipulations were of little help to the Tobyhanna, PA resident.  A neurologist from Dunmore, PA administered numerous cervical nerve block injections.

An MRI of his right shoulder showed a full thickness tear of the rotator cuff tendon.  A Scranton, PA orthopaedic surgeon performed rotator cuff surgery on the UM victim which included the removal of the sub-deltoid bursa and an acromioplasty.

The initial settlement offer for the uninsured motorist claim was insufficient.  The Sworn Statement of the personal injury victim was then taken.  Thereafter, Attorney Newell was able to negotiate a $75,000.00 settlement for the UM claim.

Lehigh County, PA

An Allentown, PA resident was driving her car on I-78 when she was cut off by a hit and run driver and forced into a retaining wall.  Upon impact, the uninsured motorist claim victim's left side hit the driver's side door.  Fortunately, at the time of the car crash she had her seatbelt on and did not lose consciousness.

The personal injury victim was initially seen an Lehigh Valley Hospital in Allentown, Pennsylvania.  She began to receive chiropractic and physical therapy care at Lehigh Valley Non-Surgical for headaches, as well as neck and left shoulder pain.

Because of the severe ongoing pain in her shoulder, the car accident victim was referred to an Allentown orthpaedic specialist who gave her two injections.  An MRI of the left shoulder showed that she had tendinitis and a tear of the dorsal surface of the infraspinatus tendon.

Attorney Newell presented an uninsured motorist claim to her motor vehicle insurance company.  He pointed out that the left shoulder tendon tear made it difficult for his client to raise her arm and perform routine household activities.  Ultimately, a UM settlement was reached to the great satisfaction of the injury victim.

Pike County, PA

A Bushkill, PA family was driving in their car in New Jersey when they were rear-ended by a hit and run driver.  The uninsured motorist claim victims promptly returned to Pennsylvania and received medical care from a family doctor, a chiropractor and a pediatrician in the Pocono Mountains.  One of the car accident victims was also seen at Pocono Medical Center in East Stroudsburg.
