Monroe County Judge Dismisses Nationwide’s Cross-Claim

A January 7, 2011 decision by Judge Linda Wallach Miller dismissed a cross-claim filed by Nationwide in a Monroe County car accident case. The negligent driver was on Coolbaugh Drive in Middle Smithfield Township. He rear-ended the car in front of him which forced that automobile into the path of a motor vehicle traveling in the opposite direction.

The Monroe County car accident victim filed suit versus the driver, as well as the owner of the car on the basis of negligent driving and negligent entrustment of the auto. A legal claim was also brought by the Monroe County car crash lawyer versus Nationwide for underinsured motorist benefits. Nationwide then filed a cross-claim versus the car driver and owner for contribution or indemnification of any amounts Nationwide had to pay its insured.

The trial judge ruled that Nationwide had no legal claim versus the defendants. There was no jury award yet versus the defendants and nor was there any result requiring Nationwide to pay UIM benefits above and beyond the defendants’liability limits. Luzerne County Auto Accident Victim Defeats Insurance Co.

A November 17, 2010 decision of the Superior Court of Pennsylvania affirmed a Luzerne County Trial Judge’s decision in favor of an injured car crash victim. A woman was injured in a car accident and successfully won her case at trial. The negligent defendant’s insurance carrier refused to pay the jury award without naming Medicare on the check. In the alternative, the defense wanted to pay the jury verdict amount into a court fund with proof required from Medicare that all its liens had been satisfied.

The Luzerne County judge ruled that neither the defendant nor its insurance company had the legal basis under the Medicare Secondary Payer Act (MSPA) to assert a Medicare lien for the United States government. Since a private party can’t bring suit to obtain reimbursement of Medicare payments, it can not mandate Medicare’s involvement in the payment of a damage award. To satisfy a judgment for monetary damages, payment of the debt owed must be made solely to the victorious party specified in the jury’s verdict. Zaleppa v. Seiwell, 9 A.3d 632 (Pa. Super. 2010).

The negligent driver lost control of the automobile which went onto the shoulder of the road, broke thru the guardrail and crashed into a tree. All 3 occupants of the car died. Lawsuits were filed by the Estates representing the driver and 1 of the passengers. Owner of Car Responsible For Crash Injuries

A 2010 opinion of the Superior Court of Pennsylvania upheld a Philadelphia County Court of Common Pleas decision in favor of a PA car crash victim and against the owner of the hit & run car.  The Pennsylvania car accident victim was stopped and waiting to make a turn when he was rear-ended.  The driver of that car fled the scene but 2 eyewitnesses took down the license plate number and provided it to the police.

The trial judge found the testimony of the owner and the alleged driver to be ‘conflicting’, ‘unreliable’ and ‘untruthful.’  The court found that the owner knew that the alleged driver did not possess a valid driver’s license in violation of Section 1574 of the Pennsylvania Vehicle Code.  The treating doctor testified that the victim sustained a nerve root injury, ulnar neuropathy and a possible brachial plexopathy which resulted in permanent nerve damage.  The restrictions on her lifestyle resulted in a finding that she exceeded the limited tort threshold.  Graham v. Car Accident Victim Able to Sue Additional Defendant

A March 2010 Decision by the Superior Court of Pennsylvania reversed an Opinion of the Philadelphia County Court of Common Pleas and allowed a Philadelphia car accident victim to join an additional defendant. Subrogation Lien for Heart & Lung Benefits

A 2009 ruling by the Commonwealth Court of Pennsylvania required an Allegheny County car accident victim to reimburse the City of Pittsburgh for Heart and Lung Act benefits paid to her. New Trial Ordered For Driver Hit by Police Car

A 2009 decision by the PA Commonwealth Court affirmed a York County Judge’s ruling in favor of a Pennsylvania car accident victim. A woman was driving to work in York when she was hit by a police car going the wrong way on a one-way street. The police officer testified at trial that he was responding to an emergency call. He claimed that he had activated his emergency lights and was using his siren at intersections.

An eyewitness testified that just prior to the car crash, the police officer was driving 15 to 25 miles per hour over the speed limit. The PA car accident victim told the jury that she did not hear or see the police car before the collision. After the evidence was presented, the jury entered a verdict in favor of the police officer and the City of York. This was based upon their belief that he was not negligent due to the emergency vehicle doctrine set forth in the Pennsylvania Motor Vehicle Code.

After the trial concluded, the York County PA judge ruled that the police officer was guilty of negligence per se. The Pennsylvania Commonwealth Court agreed and ordered that a new trial take place to determine if the PA car accident victim was contributory negligent and, if necessary, enter a damage award. Insurance Company Discovery Request Denied

An October 2009 ruling by Judge Panchik of the Armstrong County Court of Common Pleas denied some discovery requests of Erie Insurance Company in a lawsuit filed by one of its insureds. A woman was injured in an automobile accident resulting in serious injuries including fractures of her foot and ankle. She did not make a full recovery and her doctor gave her a physical therapy prescription.

Erie was her auto 1st party insurance company and denied payment for the p.t. After a PRO review claimed that the physical therapy was neither reasonable nor necessary, her Pennsylvania personal injury lawyer filed a lawsuit vs. Erie. Erie then forwarded Interrogatories which in part demanded discovery documents from the PA car crash victim’s lawsuit versus the defendant driver who caused the motor vehicle accident.

Judge Panchik ruled that the plaintiff was not responsible to provide Erie with copies of documents in the public domain equally available to Erie. Insured Must Submit to Medical Exam if Request Reasonable

In a 2009 Decision, the United States District Court ruled that a car insurance company has the legal right to follow the procedure in its insurance contract and require a Pennsylvania car crash victim to submit to a medical exam without a court order.

PennDOT Immune From Lawsuit Over Lack of Guardrail

A 2008 decision by the Commonwealth Court of Pennsylvania continued the long line of legal decisions denying victims the right to receive a personal injury award from a Pennsylvania car crash allegedly caused by the lack of a guardrail. A tragic PA car accident occurred when an automobile left the highway, hit a utility pole and two trees – rolling over before coming to a stop. The car crash resulted in the death of both occupants.

Eyewitness Can Testify to Speed of Car Pre-Crash

A 2008 ruling of the PA Superior Court reaffirmed past legal decisions that a lay witness can testify as to the speed of an automobile before a Pennsylvania car accident. A car crash occurred in Philadelphia between a car and a bus. At trial, a passenger in the bus with 18 years of driving experience, testified that the driver of the car was going 40 to 45 miles per hour.

She also stated that the auto was back far enough to give the driver plenty of time to stop and avoid the PA car crash had she been paying attention to the roadway. The jury returned a verdict in favor of the bus driver and his employer due to their finding that the driver’s negligence was the primary cause of the car accident.
