PEDESTRIAN MEDICAL BILLS

I was walking in the crosswalk on Main St. when a car hit me.  Why should my car insurance company pay my medical bills when the PA pedestrian accident was caused by the negligent driver?

  • Pennsylvania is a "no-fault" state.
  • Your own auto insurance carrier pays your medical bills regardless of who was at fault for the Pennsylvania pedestrian accident.
  • Your automobile insurance rates can NOT go up because of the payments of your medical bills.

My son was walking on campus at Lehigh University when he was hit by a car.  Will the driver's insurance company pay his medical bills?

  • When a car hits a pedestrian, the pedestrian's Pennsylvania car insurance company pays the medical bills.
  • If your son doesn't own a car but still uses your home as his primary residence, your insurance company will pay.
  • Remember, your car insurance premiums can not be increased due to medical bill payments after a Pennsylvania pedestrian accident.

I was a pedestrian hit by a car in Stroudsburg PA.  I live alone and don't own a car.  Who pays for my medical bills?

  • Pennsylvania law regarding pedestrian accident cases requires the driver's insurance company to pay your medical bills regardless of who is at fault for the pedestrian-car accident.

If the medical bills after a Pennsylvania pedestrian accident are higher than my medical coverage on my car insurance policy, who is responsible for my unpaid medical bills?

  • If you have private health insurance coverage, they will pay the medical bills after your Pennsylvania pedestrian accident lawyer supplies them with proof that you used up your auto coverage.
  • If you do not have private health insurance coverage or if they don't cover the medical care that you need, your PA pedestrian accident attorney will make those outstanding medical bills a part of your personal injury claim.

Please visit PEDESTRIAN ACCIDENT RESULTS for Attorney Newell's Pennsylvania pedestrian accident case summaries.

PEDESTRIAN MEDICAL CARE

I have a pedestrian accident case after a car hit me on Broad St. in Bethlehem PA.  Do I need to obtain any referrals or pre-certifications before starting my medical care?

  • No.  When a car hits a pedestrian, each Pennsylvania pedestrian accident victim makes their own decisions as to what type of medical care to get.  They also choose their own doctors.

I need chiropractic care and physical therapy after I was hit while walking to the Perkasie PA post office.  Is there a maximum number of visits allowed under my automobile insurance policy?

  • No.  A Pennsylvania pedestrian accident victim does not have any pre-set limits for chiropractic care or physical therapy.

I want to see a specialist after my pedestrian accident in Stroudsburg PA.  Do I have to pay any co-pays or deductibles in order to see the doctor?

  • No.  The doctor's office bills the automobile insurance company directly.  You do not have any out-of-pocket expenses.

Please see HOME for information regarding Attorney Newell's experience and qualifications to represent Pennsylvania pedestrian knockdown victims.

PEDESTRIAN LOST WAGES

I lost time from work after being a pedestrian accident victim in an Allentown PA crash.  Who pays for my lost wages?

  • If you paid for that optional coverage with your insurance company, they will pay your wage loss claim.
  • If you don't have wage loss coverage with your carrier, your Pennsylvania pedestrian accident attorney will add that loss to the value of your personal injury case when negotiating with the defendant's car insurance company.

If I paid for lost wage coverage on my automobile insurance policy, do I receive 100% of my lost wages after my pedestrian accident in the Lehigh Valley?

  • No.  There is no payment for the 1st five work days missed and, then . . .
  • Your car insurance pays 80% of your gross wages up to the monthly maximum you paid for.

How do I recover my lost wages not paid by my car insurance policy after my Bucks County PA pedestrian accident?

  • Your Pennsylvania pedestrian accident lawyer should demand that the Defendant's insurance coverage pay:
    • your first 5 work days missed
    • 20% of your gross wages up to your monthly maximum
    • 100% of your wages which exceed your monthly maximum coverage amount

If I use sick leave or vacation time to pay for work days missed due to my Pocono Mtns. pedestrian accident, is the negligent car driver responsible to pay me for that loss?

  • Yes.  The driver's insurance company must repay you for benefits you used up after your PA pedestrian accident.
  • Your Pennsylvania pedestrian accident attorney should not accept any denial of this claim by the Defendant's insurance carrier based upon a "double recovery" theory of defense.

Please go to CLIENT REVIEWS to obtain information regarding the experiences of nearly 30 of Attorney Newell's former PA personal injury clients.

PEDESTRIAN TORT OPTION

I was hit by a car while walking along Rt. 611 near Doylestown PA.  Does the tort option on my car insurance policy control whether or not I can make a Pennsylvania pedestrian accident claim?

  • No.  By law, a Pennsylvania pedestrian accident victim is a "full tort" claimant regardless of the tort option they chose on their automobile policy.

Please visit WHY ATTORNEY NEWELL to read about his qualifications to serve as your PA pedestrian accident lawyer.

PEDESTRIAN RIGHT-OF-WAY

I was a pedestrian accident victim in Bethlehem, PA after being hit by a car while I was in a crosswalk. Who has the right-of-way?

  • The driver of any motor vehicle is required to yield the right-of-way to a Pennsylvania pedestrian crossing the road within any marked crosswalk.

I was walking thru an intersection near Route 309 in the Lehigh Valley with a green light.  An SUV made a left turn and hit me.  Do I have a Pennsylvania pedestrian accident claim?

  • Yes.  Since you were crossing the intersection with the light, the SUV making a left turn from Rt. 309 was required to yield the right-of-way to you.

What are the duties of a PA pedestrian who chooses to cross in the middle of the road, not at a crosswalk or at an intersection with a traffic light?

  • The Pennsylvania pedestrian must yield the right-of-way to all motor vehicles on the road.
  • The pedestrian's duty to yield the right-of-way is mandatory, regardless of the alleged speed of the motor vehicle.

PEDESTRIAN DUTIES

I was walking along the shoulder of Rt. 313 near Quakertown PA WITH the flow of traffic when I was struck by a car. Did I violate any laws?

  • The Pennsylvania Vehicle Code requires pedestrians to walk AGAINST the flow of traffic when there are no available sidewalks.

PEDESTRIAN UM/HIT & RUN

Do I have a pedestrian accident claim after being hit by an uninsured motorist on Broad St. in Lansdale PA?

  • If you paid for uninsured motorist coverage on your auto policy, you are able to make a PA UM claim after your pedestrian-car accident.

DEALING WITH INSURANCE CO.

After my pedestrian accident in Easton PA, the defendant's car insurance company called me and asked me to give a recorded statement.  Should I cooperate with them?

  • No.  They are professionals only looking out for their insured's interests.
  • Your PA pedestrian accident attorney can protect your legal rights while also providing the car insurance company with sufficient information to complete its investigation.

PEDESTRIAN DEFENSE EXAM

Can the driver's insurance company require me to be examined by one of its doctors after my Pennsylvania pedestrian accident?

  • If the case couldn't be settled and a lawsuit was filed, the defense has a right to have you examined by a physician of their choice.
  • Your PA pedestrian accident lawyer is entitled to attend the exam with you and receive a copy of their expert's report when it is submitted to the defense attorney.

PEDESTRIAN PEER REVIEW

I became a pedestrian accident victim after being hit by a car on Rt. 209 in Lehighton PA.  My car insurance company is questioning my need for ongoing physical therapy.  Am I required to attend an exam scheduled with one of their doctors?

  • If your automobile insurance contract provides them with that right and their request is medically reasonable, you are required to attend the peer review.
