Chester County Pit Bull Attack Lawsuit Filed

Posted on: October 27th, 2012       Attorney Thomas Newell

On Oct. 19, 2012, Attorney Thomas J. Newell filed a lawsuit in Chester County PA Court of Common Pleas on behalf of a West Chester PA pit bull attack victim.  The 10 page Complaint alleged that a four year old girl was attacked by the defendant’s 2 pit bull mixed breed dogs at a family party.

The pit bulls had a history of prior vicious propensities – which background was known to their owner.  The pit bulls had previously attacked and injured another dog.  The Chester County pit bull attack victim suffered lacerations and dog bite wounds to her head and neck that required staples and stitches to close.

Attorney Newell’s Complaint included claims that the defendant violated the PA Dog Law, as well as a count for punitive damages.  If you or a loved one have been attacked by a dog in PA, call 1-800-980-4842 ASAP to set up your free home consultation with Attorney Newell.  Please visit his website:  www.PADogAttackLawyer.com.

Posted on: October 8th, 2012       Attorney Thomas Newell

On Oct. 4, 2012, rottweiler owner Rhkiah Harris a/k/a Rahkiah Lee-Harris was found guilty of multiple PA Dog Law violations by District Justice Brian Germano of Marshalls Creek PA.  The East Stroudsburg PA rottweiler owner allegedly confines her vicious dog by either tethering it to a tree or housing it in an outdoor kennel.

On June 13, 2012, the aggressive rottweiler got loose, ran around the back of the house and attacked a 10 year old boy who was playing basketball with the defendant’s sons.  The 10 year old Monroe County dog bite victim instinctively put up his left arm to protect his face.  The rottweiler bit his left arm and the boy was taken to Pocono Medical Care Center in East Stroudsburg PA.

The defendant was found guilty of harboring a dangerous dog, failure to confine her rottweiler and not having an up-to-date dog license.  Attorney Newell attended the hearing and presented the court with applicable legal precedent, as well as his opinion regarding the PA Dog Law statutes.

On October 1, 2012, PA Dog bite attorney, Thomas J. Newell, Esquire obtained York County court approval of a $508,613.84 settlement in a PA pit bull attack case.  Back on June 1, 2010, Ajia Brown and his mother, Elizabeth Brown, were guests of Marjorie Nicholson in Hanover, PA.  Two pit bulls were housed in a small 3-1/2′ high enclosed pen behind the home.  The pit bulls escaped and began to maul Ajia.  His mother ran out of the house and tried to rescue her son.

The pit bulls knocked Ajia to the ground, one began biting his head/face, the other Ajia’s lower torso.  Ms. Brown jumped on top of her son to save his life.  Neighbors came out and began hitting the pit bulls with garden hoses and a shovel.  Finally, Elizabeth and Ajia were able to escape into the home.  Hanover Borough Police Officers then arrived on the scene.  Officer Miles needed 3 shots to subdue one of the pit bulls.

Ajia was rushed to Penn State Hershey Medical Center where he was hospitalized for 8 days.  The Browns returned home to CT and Ajia was placed under the care of the surgeons at Yale-New Haven Hospital.  He ultimately underwent 17 surgeries in order to reconstruct his ears and cover up his severe scalp wounds.  46 injections were administered into his head to assist the surgically implanted scalp expanders.  Ajia’s medical bills totaled in excess of $500,000.00.

On October 1st, Judge Penny L. Blackwell of the York County Court of Common Pleas approved the settlement which provides a guaranteed annuity payout to Ajia of $406,173.13.  Attorney Newell has recently represented PA dog bite victims in 14 different counties.  Some of his recent dog bite claim victories include:  Bucks Co. $148,544.00, Monroe Co. $135,255.27, Lehigh Co. $132,000.00, Monroe Co. $117,460.00, Lebanon Co. $101,000.00,  Northumberland Co. $101,000.00 and York Co. $92,268.00.  More information about Attorney Newell’s 31 years of experience can be found at www.PADogAttackLawyer.com.
