Fatal Berks County Car Crash

A January 26, 2013 article in The Morning Call reported on a 1/25/13 fatal PA car accident on Route 100 in Hereford Township.  Pennsylvania State Police concluded that a 46 year-old Berks County PA resident made a left turn in front of oncoming traffic on Rt. 100 about 6 miles south of Emmaus.  He was taken to Lehigh Valley Hospital in Allentown where he died a short time later.

AUTO CRASHThe driver of the other vehicle was a 42 year old woman from Gilbertsville PA.  The Montco auto accident victim apparently sustained serious injuries and was also taken to LV Hospital where she was listed in critical condition.  PA State Police continue to investigate this fatal car crash.

Tethered Pit Bull Kills 4 Year Old Boy

On January 19, 2013, a 4 year-old boy was mauled to death by a chained pit bull.  The Montgomery County, Texas resident had climbed over his backyard fence and into his neighbor’s yard.  There was a tethered pit bull that inflicted severe injuries to the small child.  The boy was medevaced to a Houston area hospital where he died that same evening.

Schuylkill County Pit Bull Owner Pleads Guilty

On January 18, 2013, Attorney Thomas J. Newell received a phone call from an Ashland PA police officer that a Schuylkill County pit bull owner had pled guilty to a PA Dog Law citation. The failure to confine violation was based upon an Ashland PA dog attack which took place on November 24, 2012.

As she was waiting to cross the road, the defendant’s 2 pit bulls jumped the fence and began to pursue her and the little dog. Allegheny County Dog Mauling Death Criminal Case Concludes

On January 14, 2013, a McKeesport PA dog owner plead guilty to child endangerment after her 2 day-old son was mauled to death by the family’s pet Husky in February of 2012.  As described in the Pittsburgh Tribune, Allegheny County Court of Common Pleas Judge Edward J. Borkowski sentenced her to a total of 5 years of probation, as well as 6 months of house arrest.

Failure to Confine Conviction After Dauphin County Dog Attack

On January 10, 2013, District Justice Rebecca Jo Margerum found a negligent Dauphin County dog owner guilty of failure to confine his boxers in violation of the PA Dog Law.  Clifford A. Schaffner was also convicted of not having his 3 dogs licensed or properly vaccinated for rabies prevention.  Present at the hearing were Dauphin County Dog Warden Michael Zeigler, Attorney Thomas J. Newell, the 30 year-old victim and the defendant.

BOXERS - 3 DOGSThe uncontroverted testimony presented to the court was that the defendant’s 3 dogs were running loose on his property without any collars, leashes or other methods of restraint.  Mr. Schaffner admitted that he was in the house at the time of the attack and did not witness it.  After he heard the victim’s screams, Mr. Schaffner came out and saw the dogs “surrounding her.”  The negligent dog owner described the victim as being “distraught and scared.”  Attorney Newell provided the court with copies of the failure to confine statute, as well as a relevant Pennsylvania Superior Court decision.

Hearing Set For Dauphin County PA Dog Law Charges
