A Nov. 17, 2010 article in The Pocono Record detailed the shift in law enforcement’s view to permit prosecution of drunk driving accidents in the private communities of Pike County and Monroe County. The article reports that there are over 56,000 homes in private developments in the Poconos. PA State Police do not patrol inside these communities and public officials were concerned over the lack of DUI prosecutions.
A recent Pike County DUI conviction showed the District Attorney’s willingness to protect all Pennsylvania residents regardless of where they live. A defendant was charged with drunk driving after he had a motorcycle crash in the Saw Creek private development in Bushkill. The defense claimed that alleged DUI violations under the PENNSYLVANIA MOTOR VEHICLE CODE would not support a conviction for an accident in a private community.
Judge Joseph Kameen ruled that since members of the public, including friends, family & contractors, have routine access to these communities, their roads should be considered as public thoroughfares.
