Punitive Damages & Drivers Using Cell Phones in PA

A July 25, 2014 article from the Legal Intelligencer discussed the varied rulings Pennsylvania Judges have issued regarding punitive damages and PA motor vehicle accidents.  On June 6, 2014, a Lehigh County Court of Common Pleas Judge granted the Preliminary Objections of the defendant driver.

The Lehigh Valley car crash victim alleged that the negligent driver acted in a reckless manner by talking on her cell phone at the time of the auto accident.  Judge Reichley struck the claim for punitive damages from the plaintiff’s Complaint as it did not aver any other facts proving reckless conduct.

In contrast, Preliminary Objections filed by a Luzerne County driver were overruled by Judge Burke on May 27, 2014. In this case, the plaintiffs alleged that the defendant driver was trying to answer 2 cell phones at once.  The Luzerne County car crash victim’s punitive damage case against the reckless driver will proceed to trial.

Lehigh Valley Motorcycle Accident Victims Contact Attorney Newell

On July 23, 2014, Attorney Thomas J. Newell spoke with a Lehigh Valley motorcycle accident victim whose Suzuki was struck by a car on 7/19/14. The Nazareth, PA ‘cyclist was riding south on Rout 512 near Wind Gap. The negligent driver pulled out from a Route 33 off-ramp and crashed into the motorcycle.

Tioga County PA Fatal MVA Crash – Justice After 8 Years?

On June 8, 2014, a Westfield, PA driver was ordered to stand trial for the death of a Tioga County woman in a fatal 2006 car accident. As described at stargate.com, the fatal Tioga County PA motor vehicle accident took place on October 27, 2006.

Rhonda and Mike Fromm were in their Dodge Intrepid on Route 287 just south of Tioga when a trailer came off a pick-up truck and crashed into their car. Mrs. Fromm died in the fatal Route 287 car accident. The defendant allegedly fled the scene and told the occupants of his truck to not discuss the accident.

Another Uninsured/Irresponsible Dog Owner

PA dog bite lawyer, Thomas J. Newell, was referred to a Luzerne County dog attack victim by another personal injury attorney. On March 11, 2014, the retired gentleman was walking on a sidewalk adjacent to his Nanticoke, PA home. The property next to his was in a neglectful state and was inhabited by a renter with an aggressive pit bull.

On this day, the unleashed & unrestrained pit bull got loose and attacked the victim without any provocation. The PA dog attack victim instinctively threw up his right arm to protect his face. The pit bull attack left him with a badly injured right hand. Surgery was needed, a pin was implanted in his ring finger and dozens of stitches were used to close the dog bite wounds.

Fatal Monroe County Car Crash Victim Still Unidentified

On April 17, 2014, a one-car crash in Paradise Township, Monroe County resulted in the death of a driver. According to Allentown’s Morning Call, the Monroe County PA fatal car crash was caused by the driver striking a utility pole and tree on Upper Swiftwater Road.

The Poconos car accident victim was apparently trapped inside the car. When Pennsylvania State Police arrived at the scene of the accident, the vehicle was engulfed in flames. PA State Police are asking eyewitnesses to call them at 570-839-7701.

Lowest # of PA Car Crash Fatalities in 85 Years

On April 9, 2014, PennDOT provided a Press Release which noted 1,208 recorded PA accident related deaths in 2013.  This is the lowest number since statistics began being compiled in 1928. According to Allentown’s Morning Call, the 7 County region encompassing the Lehigh Valley totaled 154 fatal car crash victims, 27 less than in 2012.

SENIOR CITIZEN DRIVERS

Deaths involving drivers age 75 and over increased to 142.  Some safety experts are concerned that certain senior citizen drivers may be driving while it is unsafe for them to do so. Experts note that older drivers may have failing eyesight and/or hearing.  425 occupants died in fatal car crashes after disregarding PA’s mandatory seat belt law.

Rt. 309 Road Rage Defendant Caught

A March 20, 2014 article from Allentown’s Morning Call detailed a recent serious case of road rage on Route 309 in Hilltown Township, Bucks County. A driver contacted police after he claims a man in a pick-up truck had brandished a pistol near the Souderton exit of Route 309.
