Contractor Liable for Bicycle Accident Victim’s Damages

A 2008 Ruling by the Superior Court of Pennsylvania resolved legal issues resulting from a serious PA bicycle accident. A police officer was riding her bike while training as a bicycle patrol officer. The bicyclist was riding in Pennypack Park when she hit a steel reinforcement bar that had been placed partially on the bicycle path during a construction project.

The Pennsylvania bicycle accident victim was thrown from her bicycle and sustained servere injuries. Her PA bicycle lawyer filed suit against PennDOT, A general contractor and a subcontractor. The attorney claimed that the Defendant’s construction work near I-95 resulted in the dangerous and negligent condition of the bicycle path.

The jury found that the general contractor was solely responsible and awarded the large verdict for the Pennsylvania bicycle accident victim. Attorneys representing the general contractor claimed that the contract language required the subcontractor to pay the bicycle accident award. The PA Superior Court ruled that the general contractor was solely liable for the negligence of its employees. That company was required to pay the PA bicycle accident victim the entire jury verdict plus delay damages. Lane v. Cmwlth of PA, 954 A.2d 615 (PA Super. 2008)
