Reckless Dog Owner Sued by Attorney Newell in Dauphin County

Posted on: December 24th, 2013       Attorney Thomas Newell

On 12/19/13, a reckless owner of three boxers from Dauphin County Pennsylvania was sued by Attorney Newell.  His client had been pursued and attacked by the boxers as she was delivering a package in Dauphin County.  Several months earlier, another Federal Express delivery person was pursued by these same unrestrained dogs.

On 1/10/13, the dog owner was found guilty by District Justice Rebecca Jo Margerum of violating both the PA Dog Law, as well as the Pennsylvania Rabies Prevention and Control in Domestic Animals and Wildlife Act.  The negligent dog owner did not offer a valid defense to the charge of violating Section 305 of the PA Dog Law – Failure to Confine.  He also did not produce any documents establishing that the boxers were up-to-date with their rabies shots.

Pittsburgh Animal Shelter Euthanizes Vicious Pit Bull

Posted on: December 18th, 2013       Attorney Thomas Newell

A December 13, 2013 article from the Pittsburgh Post Gazette described the recent decision by a Pittsburgh Animal Shelter to euthanize a pit bull that had attacked other dogs in 2 separate incidents.  Earlier this year, a Jack Russell Terrier had gotten out of its cage and “ran right by Blue (the pit bull) that was being walked on a leash.”  While Attorney Newell can’t conceive how the actions of the Jack Terrier would have warranted an attack, the pit bull killed the terrier.

While “human error” apparently permitted the terrier to escape from its pen, this author can’t comprehend how this could have been reasonably viewed as anything other than an unprovoked attack by the pit bull.  Nonetheless, the pit bull was permitted to remain at “Animal Friends.”  Just before Thanksgiving, the pit bull attacked again, this time versus a leashed pit bull.  Finally, the animal shelter did the right thing and put the pit bull down.

Attorney Thomas J. Newell has represented many pit bull attack victims throughout the course of his 32 year career.  Whether it’s an American Pit Bull Terrier or American Staffordshire Terrier, the breeds we commonly refer to as “pit bulls” typically cause severe injuries to other dogs and human beings.  Attorney Newell believes their breeding, strength, ferocity and jaw anatomy is without equal in the world of dogs owned by the typical family here in Pennsylvania.  Call Attorney Newell @ 800-980-4842 if you’ve been bitten by a dog.  Visit his website:

A November 12, 2013 report on WGAL TV highlighted multiple criminal charges filed against a Lancaster pit bull owner.  She had purchased an 11 month old pit bull and was specifically warned not to leave the dog around children due to its aggressive demeanor.  The new owner disregarded the warning and dropped off the pit bull at her residence where 4 children were inside.

PIT BULL #12Soon thereafter, the vicious pit bull began an unprovoked attack on a 5 year-old girl causing serious injuries.  The defendant then went to the work place of the former owner and punched her – an act caught on the store’s video surveillance.  The police have charged the pit bull owner with simple assault and recklessly endangering the welfare of a child.

On August 14, 2013, a 50 year old Buckingham Township resident was attacked by a neighbor’s pit bull.  The Bucks County dog attack victim was cleaning brush away from his fence when the pit bull came charging after him.  The pit bull scratched both of the gentlemen’s legs and knocked him to the ground.

PIT BULL #4The PA dog bite victim fell and hit his head on the fence.  He also injured his right hand and stitches from a previous incident opened up.  Neither the pit bull nor a mixed breed dog and German Shepherd owned by the defendants were on a leash or restrained in any way.  Attorney Thomas J. Newell suggested to the Bucks County PA resident that he contact the Bucks County Dog Warden Joseph Loughlin.

A July 1, 2013 article from The Morning Call reviewed a new ordinance adopted by Salisbury Township in Lehigh County.  The law bans dogs in all of its parks/open spaces except for Franko Farm and Walking Purchase Park.  Dogs will be allowed there provided they are leashed and under the control of its owner.

DOGS MUST BE LEASHEDAttorney Newell believes this new law was enacted in response to multiple dog attacks within Salisbury Township in 2013.  Both people and other dogs have been injured as a result of unleashed/unrestrained vicious dogs running loose in the Township.
