Chester County Judge Agrees with Attorney Newell re: Punitive Damage Claim

Posted on: March 14th, 2013       Attorney Thomas Newell

On March 7, 2013, Attorney Thomas J. Newell received a Court Order which permitted him to move forward to trial with a punitive damage count versus a negligent West Chester PA pit bull owner. The 3/4/13 Order of Judge Ann Marie Wheatcraft overruled the defendant’s preliminary objections to the complaint Attorney Newell had filed.

PIT BULLS - TWOThe Chester County pit bull attack victim had been mauled on April 24, 2011 by the defendant’s 2 pit bull mixed breed dogs. The vicious dogs had displayed prior vicious propensities and the negligent pit bull owner had not taken any precautions to protect the 4 year old child. The defendant’s insurance company had failed to make a reasonable settlement offer, so Attorney Newell filed a lawsuit to protect his client’s legal rights.
